Sec. 1 Scope and definition of terms
These Terms of Use apply to all services offered over the Clippic App.
The following Terms of Use apply exclusively to the business relationship between Clippic (hereinafter: “Clippic” or “We”) and you, the user of Clippic (hereinafter: “You”).
The amended version at the time the agreement is concluded is decisive in each case. We may update and change these Terms of Use from time to time. You can view the current version of these Terms of Use at any time under:
The following applies to subsequent amendments to the Terms of Use within the framework of an existing contractual relationship: Clippic will inform you in good time about the planned amendment. If the user does not object to the amendment within 4 weeks, it is considered to mean acceptance of the amended Terms of Use. Clippic will make special reference to the consequence for the user of remaining silent when announcing the planned amendments. If you object to the amendment to the Terms of Use, Clippic is entitled to terminate the agreement for extraordinary reasons.
Conflicting or deviating terms and conditions will not be recognised unless we expressly agree to their validity in writing. The following Terms of Use also apply exclusively if we perform the delivery and service without reservation in the knowledge of the conflicting and/or deviating terms of use.
Sec. 2 Description of the service
Clippic is an application that customers can use to create, edit and export their own so-called Clippics and/or edit and export Clippics from other users. A Clippic is a file (or printed medium) that connects, for example, a video and a photo. Following free registration, the platform allows users to create a profile and search for and request other user profiles.
To use the service, you have to register over the Clippic App.
The user can register and log in using his email and a password. The application cannot be used in full without registering first.
Entrepreneurs in the sense of Sec. 14 GCC (BGB) are obliged to mark their profile as such when creating an account. The registration of several accounts to one person is not permitted. We reserve the right to delete such accounts.
On request, the user is obliged to confirm their identity to Clippic by providing appropriate proof of identity.
The language of the service or parts thereof is German and may not be available in all countries. We do not guarantee that the service on Clippic or parts thereof are suitable for a certain region.
We reserve the right to temporarily or permanently change, update, modify or discontinue the services (or parts thereof) at any time without notice.
Sec. 3 Clippic Account
Only public Clippics can be exported without an account. Registration is free of charge. Natural persons aged 18 and over who are able to conclude a legally binding agreement, and minors between the ages of 14 and 18 with the consent of their parents, are allowed to use Clippic.
Accounts cannot be transferred.
You confirm that all the information you provide to Clippic when registering and/or taking up membership is correct, complete, accurate and up-to-date.
If the data you enter during registration and/or taking up membership changes, you are responsible for updating it yourself. You confirm that you will maintain and update this data during the term of your membership on Clippic in order to keep it up to date.
If you create an account using the Clippic App, you will be asked to protect it using a password. You agree that it is your responsibility to maintain the confidentiality and security of your password. You understand and acknowledge that you are solely responsible and liable for any activity that takes place under your account unless you can prove that you did not breach your duty of care.
You confirm and agree that the account is only intended for your personal use or, in the case of members who are minors, only for use by the member themselves and that you are not permitted to disclose your account and/or password to third parties.
Sec. 4 Obligation to cooperate and your conduct
When using Clippic, you are obliged to observe all applicable laws and other legal provisions of the Federal Republic of Germany. You are prohibited from publishing data or content that breaches legal provisions or third party property rights, copyrights and other rights.
You may not use software, nor any other technologies or processes that relate to the use of Clippic that are likely to affect the operation, security and availability of the services and the platform on which they are staged.
Sec. 5 Warranty and liability
Unless otherwise regulated below, we are liable for material and legal defects in accordance with the applicable statutory provisions, and, in particular, Sec. 434 ff. GCC (BGB). The limitation period for legal claims for defects is two years. The warranty period for software that Clippic supplies to entrepreneurs is twelve months. The limitation period begins when the software is downloaded.
We are only liable for slight negligence if essential obligations are breached, i.e. obligations whose fulfilment makes the proper performance of the agreement possible in the first place and on whose compliance you can regularly trust and rely. In the event of a breach of such obligations, our liability is limited to damages whose occurrence is typically to be expected within the framework of the respective agreement. Liability for slight negligence is excluded in all other cases. The aforementioned liability limitations do not apply to damages that result from the breach of a guarantee or the culpable loss of life, limb or health in the event of intent or gross negligence, as well as mandatory legal liability under the Product Liability Act (ProdHaftG). The liability of Clippic’s executive bodies, employees and agents is excluded to the same extent as the liability of Clippic.
Clippic assumes no guarantee or liability for the permanent electronic availability of the electronic platform as limitations may occur owing to technical requirements. Interruptions in the quality of the Internet access and data traffic owing to force majeure and events beyond the control of Clippic that make the services considerably more difficult or impossible to provide do not give rise to a cause for claiming compensation for unavailability.

Sec. 7 Final Provisions
The law of the Federal Republic of Germany applies to agreement between Clippic and you under exclusion of the UN Convention on Contracts for the International Sale of Goods.
If the partner to the agreement is a merchant, legal entity under public law or special fund under public law, the place of jurisdiction is Gelsenkirchen, Germany. However, Clippic is also entitled to take legal action at partner’s place of business.
